Terms and Conditions
Confirmation of Order
Once DATA SYSTEMS have received an order
via e-mail they will contact the Customer to confirm the value of the order
and delivery dates. At this time the buyer has the option to change the order
or cancel.
Once agreement has been reached, an invoice
will be sent which includes full pricing which will normally be as entered initially
by the Customer when selecting equipment.
Deliveries can be made to any business or
private address in the UK and DATA SYSTEMS will confirm dates and the Customer
will ensure that there will be someone available to accept the goods.
Payment Terms
Payment terms are C.O.D - cheque on delivery
or cheque with order. If couriers are to collect a cheque made out to DATA SYSTEMS
when they deliver, the delivery costs are as calculated when placing an order.
If cheque with order, DATA SYSTEMS will wait to receive the cheque before despatching
equipment and will reduce the delivery costs by £ 7.50.
Delivery Timescale
Most products we sell can be supplied within
3 to 4 working days from the order confirmation date. If there is a possibility
that this timescale will not be met DATA SYSTEMS will advise the Customer at
the time of discussing the order.
DATA SYSTEMS will endeavour to deliver the goods
on a date notified to the Customer but does not guarantee to do so. The time
of delivery shall not be the essence of the contract. Under no circumstances
will DATA SYSTEMS be liable if delivery is delayed by any cause beyond the reasonable
control of DATA SYSTEMS or its servants or agents. It is expressly agreed that
DATA SYSTEMS shall not be under any liability to the Customer for consequential
loss arising as a result of late delivery.
Warranty
Unless otherwise stated at time of order,
all hardware will be subject to 12 months return to base warranty. This means
that if a problem cannot be resolved over the telephone the Customer, at his
expense, will be asked to send the hardware back to DATA SYSTEMS who will repair
the problem or replace the equipment and return to the Customer at no charge
during the warranty period.
Condition of Equipment
Where the equipment is advertised as secondhand
or refurbished DATA SYSTEMS guarantee it to be in a working condition. It will
be clean and although there may be small scratch marks on the external case,
this will not be unsightly.
Software Licensing
Where DATA SYSTEMS install and/or sell software,
they will charge for this and always provide a software licence to cover the
software.
Acceptance of Goods
Wherever possible the Customer should satisfy
himself that the goods have not been damaged in transit. If it is not possible
to check while the driver is present, please sign - 'Accepted without inspection'.
The Customer has the right to return the goods
if he is not satisfied and DATA SYSTEMS will provide a full repayment, less
any delivery charges, provided they are informed and receive the goods in an
undamaged condition within 14 days of the date of first receipt by the customer.
The customer should inform DATA SYSTEMS by telephone
immediately of any shortage in a delivery.
Ownership of Goods
All products sold will remain the property
of DATA SYSTEMS until payment has been received in full (cheque cleared).
Force Majeure
Neither party shall be liable to the other
for any delay, loss, damage or injury caused by Acts of God, strikes, lockouts,
civil commotion, riots, war, fire, explosions, sabotage, storm, flood, earthquake,
fog, subsidence or requisition of labour or materials for State purpose or any
other cause beyond their control.
Limitation of Liability
The liability of DATA SYSTEMS in respect
of any breach of these conditions or any default, act or omission of DATA SYSTEMS,
its servants or agents or subcontractors in relation to the subject matter of
the contract and for which DATA SYSTEMS is legally liable to the Customer shall
be limited to damages, such damages shall be limited to the contract price of
the goods. DATA SYSTEMS shall not be liable for any consequential loss or damage
however caused, including (but not limited to) liability for business interruption
or loss of profits.
